1. Introduction
Welcome to Alibely. These Terms of Service ("Terms") govern your access to and use of the Alibely website, mobile application, and related services (collectively, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Eligibility
To use the Alibely Platform:
- You must be at least 18 years old.
- You must possess the legal authority to enter into a binding agreement.
- Drivers must hold a valid driving license, vehicle permit, and insurance as per applicable Indian laws.
3. Account Registration
- You must create an account using accurate personal information.
- You are responsible for maintaining the confidentiality of your login credentials.
- Any unauthorized use of your account must be reported to Alibely immediately.
- Alibely may suspend or terminate your account if you provide false information or violate these Terms.
4. Services
- Riders may request transportation services through the Platform.
- Once a Driver accepts a booking, a contract for service is formed directly between Rider and Driver.
- Alibely is not a party to this contract.
- Alibely reserves the right to modify or discontinue services at any time.
5. Payments
- Fares are calculated based on factors such as distance, time, and demand.
- Payments are made through the Alibely app or website using authorized payment gateways.
- Alibely may deduct a service fee/commission from Drivers for using the Platform.
- All payments are non-refundable except as required by law or under Alibely's refund policy.
6. Cancellations and Refunds
- Riders may cancel a booking before the ride starts.
- Cancellation fees may apply.
- Refunds, if applicable, will be processed within 7–10 business days.
- Alibely reserves the right to cancel a ride in case of driver unavailability or safety concerns.
7. User Conduct
You agree not to:
- Use the Platform for unlawful purposes.
- Disrupt or damage the Platform's functionality.
- Harm, threaten, or harass Drivers, Riders, or Alibely employees.
- Use multiple accounts or impersonate others.
Alibely reserves the right to suspend or ban users/drivers violating these conditions.
8. Driver Obligations
Drivers must:
- Comply with all traffic, safety, and transport laws.
- Maintain their vehicle in safe, clean, and lawful condition.
- Not engage in illegal or unsafe conduct during rides.
- Accept ride requests only when they are available and authorized to drive.
Alibely may suspend driver access for poor performance, misconduct, or complaints.
9. Insurance and Liability
- Riders and Drivers are encouraged to maintain personal accident and third-party insurance.
- Alibely provides only limited platform-based coverage as per law.
- Alibely is not liable for:
- Accidents, delays, or damages arising during rides.
- Loss of belongings.
- Acts or omissions of Drivers or Riders.
10. Intellectual Property
All content, software, and trademarks on the Alibely Platform are owned by or licensed to Alibely.
Users are granted a limited, non-exclusive license to access the Platform for personal use.
11. Privacy
Your personal data will be processed according to our Privacy Policy (available on our website).
By using Alibely, you consent to such processing in compliance with the Information Technology (Reasonable Security Practices and Procedures) Rules, 2011.
12. Dispute Resolution
- Disputes between Riders and Drivers should first be reported to Alibely's support team.
- Any disputes with Alibely shall be governed by Indian law, under the jurisdiction of Ahmedabad, Gujarat.
- Arbitration may be used for certain disputes, as per the Arbitration and Conciliation Act, 1996.
13. Termination
Alibely may suspend or terminate your access if:
- You violate these Terms;
- Fraudulent activity is detected; or
- Legal or regulatory reasons require it.
Upon termination, all outstanding payments or obligations will remain enforceable.
14. Limitation of Liability
To the maximum extent permitted by law:
- Alibely is not responsible for direct, indirect, or consequential losses resulting from Platform use.
- Alibely provides its Platform "as is", without warranties of any kind.
15. Changes to Terms
Alibely may modify these Terms at any time.
Updated Terms will be posted on www.alibely.com and will take effect immediately upon posting.
